Terms and Conditions of the Bettermaker Online Store
Chapter 1. General Provisions and Contact with the Store Owner
1. These Terms and Conditions (hereinafter the "Terms") set out the rules and conditions of using the Bettermaker online store, available at: https://bettermaker.eu.
2. The owner of the Store is Addicted To Music Sp. z o.o., registered office: Egipska 4, 03-977 Warsaw, Poland, entered in the Register of Entrepreneurs of the National Court Register under number KRS: 0000947894, VAT ID (NIP): PL1133049448, REGON: 521039272 (hereinafter the "Seller").

4. These Terms contain in particular:
a. information on the e-commerce service provided by the Seller, i.e. enabling customers to purchase goods and digital content/services online (hereinafter the "Store Service"),
b. information necessary for using the Store Service.
Chapter 2. Technical Requirements
To use the Store, the Customer must have:
a. a computer or other device with internet browser access,
b. internet connection,
c. an active email account.
Chapter 3. Personal Data
1. The Seller is the data controller of personal data of the Store’s Customers.
2. Full information on the processing of personal data can be found in the Privacy Policy, in compliance with the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679).
Chapter 4. Conclusion of Sales Agreement / Customer Account
1. The Store enables the purchase of goods ("Goods") and digital products or services ("Digital Products") either:
a. without registration, or
b. with registration by creating a Customer Account ("Account").
2. Product descriptions and prices presented in the Store constitute an invitation to enter into a sales agreement within the meaning of Article 71 of the Polish Civil Code and applicable EU e-commerce law.
3. In order to place an order, the Customer must provide the required data necessary for order execution, and optionally data for a VAT invoice.
4. When an Account is created, the Customer logs in with their email address and password. The Account allows access to order history and faster order placement in the future.
5. The Customer may delete the Account at any time free of charge by contacting: orders@bettermaker.eu.
6. Clicking the "Buy and Pay" button (or equivalent) means:
a. making a purchase offer to the Seller in accordance with these Terms,
b. accepting the obligation to pay for the selected Goods/Digital Products and delivery costs.
7. The agreement ("Agreement") is concluded when the Seller confirms acceptance of the order via email.
8. If execution of the order is impossible, the Seller will inform the Customer and refund any payments made.
Chapter 5. Prices and Payment Methods
1. Prices are given in Polish zloty (PLN) and include VAT. Prices may also be displayed in EUR and other currencies for international customers.
2. Delivery costs are shown separately during checkout. Digital Products are delivered electronically free of shipping charges.
3. Available payment methods:
- Bank transfer to Seller’s account,
- Fast electronic transfer / BLIK / e-wallets via: Autopay, eCard, Dotpay, PayPal, PayU, Przelewy24, Tpay.com,
- Credit/debit cards: Visa, Visa Electron, MasterCard, MasterCard Electronic.
4. If bank transfer is chosen, payment must be made within 7 days. Lack of payment means the order is cancelled (unless deferred/instalment payment via third-party provider applies).
Chapter 6. Delivery of Goods
1. Goods are delivered by courier service.
2. Orders are considered fulfilled upon dispatch to the Customer. The actual delivery date depends on the carrier.
3. Goods are shipped within 7 business days unless a different lead time is indicated.
4. Deliveries are available in Poland and across Europe. Shipping costs are shown at checkout or individually agreed for specific destinations.
Chapter 7. Delivery of Digital Products
1. Digital Products are delivered electronically to the Customer’s email address, unless otherwise stated.
2. Access may require a dedicated platform account created free of charge for the Customer.
3. The duration of access (e.g. 1 year) is specified in the product description.
4. Customers must use the platform lawfully and respect copyright.
5. Unless otherwise indicated, Digital Products may only be used for personal purposes. Redistribution without Seller’s consent is prohibited.
6. Updates are provided only if expressly stated in the product description.
Chapter 8. Right of Withdrawal
1. Consumers and "Privileged Entrepreneurs" (as defined in Polish consumer law and EU Directive 2011/83/EU) have the right to withdraw from a distance sales agreement within 14 days without giving a reason, except in cases specified in Chapter 9.
2. For Digital Products, the right of withdrawal does not apply once delivery has started with the Customer’s prior explicit consent and acknowledgment of losing the right to withdraw.
3. Withdrawal may be declared by email (orders@bettermaker.eu) or in writing (Egipska 4, 03-977 Warsaw, Poland).
4. A withdrawal form template is available on the Store website.
5. The Customer must return Goods at their own cost within 14 days of withdrawal.
6. The Seller refunds payments (including standard delivery cost) within 14 days of receiving the Goods or proof of return.
7. Refunds are made using the same payment method unless otherwise agreed.
Chapter 9. Exceptions to Withdrawal Right
The right of withdrawal does not apply to contracts for:
a. personalised/non-prefabricated goods,
b. perishable goods,
c. sealed goods opened after delivery that cannot be returned for health/hygiene reasons,
d. sealed audio/video recordings or software once opened,
e. goods inseparably mixed with other goods,
f. newspapers, periodicals or magazines (except subscriptions),
g. goods/services dependent on financial market fluctuations,
h. alcoholic beverages with deferred delivery exceeding 30 days.
Chapter 10. Complaints
1. The Seller must provide Goods and Digital Products in conformity with the Agreement.
2. Consumers and Privileged Entrepreneurs benefit from statutory conformity guarantees under EU Directive 2019/771 and national laws.
3. Complaints may be submitted by email or post (orders@bettermaker.eu, Egipska 4, 03-977 Warsaw).
4. Complaints are reviewed within 14 days.
5. Customers may also use alternative dispute resolution (ADR) methods, including:
- mediation by Trade Inspection in Poland,
- consumer ombudsman assistance,
- EU ODR (Online Dispute Resolution) platform: https://ec.europa.eu/consumers/odr (service ends July 20, 2025).
Chapter 11. Accessibility
The Store and Terms are accessible electronically in formats compatible with assistive technologies and meet accessibility requirements (contrast, text readability, etc.).
Chapter 12. Final Provisions
1. Polish law applies, with mandatory consumer protection provisions of the Customer’s country of residence prevailing in cross-border transactions.
2. Nothing in these Terms limits consumer rights under EU or national law.
3. The Seller may amend these Terms; Customers with Accounts or ongoing contracts will be notified and may reject the changes.
4. Effective date: 06 August 2025.

Account Terms and Conditions
1. Creating an Account means entering into a free, indefinite electronic service agreement.
2. Customers may cancel the Account at any time by emailing orders@bettermaker.eu.
3. Consumers have the right to withdraw within 14 days of Account creation.
4. The Seller is responsible for conformity of the Account service with the Agreement under applicable law.
5. Complaints and dispute resolution follow Chapter 10 of the Store Terms.
6. Personal data processing information is available in the Privacy Policy.

Newsletter Terms and Conditions
1. The Newsletter is a free service consisting of periodic marketing emails sent to subscribers.
2. Subscription occurs by entering an email address in the Store or during checkout by ticking a consent box.
3. Bonuses (discount codes, free e-books, etc.) may be offered for subscribing.
4. Subscription is indefinite and may be cancelled at any time via the unsubscribe link or by contacting the Seller.
5. The Seller may discontinue the Newsletter service at any time with notice to Subscribers.
6. Inactivity (not opening emails for more than 18 months) may result in automatic unsubscribing.
7. The Seller is responsible for conformity of the Newsletter service with applicable consumer law.
8. Complaints and dispute resolution follow Chapter 10 of the Store Terms.
